New limits on state pollution rules

Beginning July 1, 2025, Tennessee agencies must meet new science standards for any new numeric limits on pollutants, contaminants, or hazardous waste. A rule must use the “best available science,” such as peer‑reviewed studies or certain EPA levels. For health‑based limits, the science must show a direct link to real bodily harm in people; animal or cell tests are allowed if no voluntary human data exist. If an agency uses EPA MCLs, RSLs, or VISLs to support a rule, it cannot set a lower number or apply them to different substances or media. This applies to rules on drinking water, water pollution, cleanups, air quality, and waste handling when they go beyond federal rules or where no federal rule exists. It does not cover rules required by federal law, rules that match federal rules, rules of the Departments of Agriculture or Health, or emergency rules.
