Beginning July 1, 2025, a conviction for any amount of fentanyl, carfentanil, remifentanil, alfentanil, thiafentanil, or a fentanyl analogue carries at least 30 days in jail. You must serve 100% of the 30-day minimum before release. After the 30 days, you may enter a certified drug or recovery court or a licensed treatment program. Also, subsection (b) of §40-7-118 does not apply to these fentanyl cases.
Beginning July 1, 2025, a victim may file a petition in the criminal court before the defendant is convicted of an offense listed in §36-3-627(a)(1). The court must serve the respondent and wait until the trial ends to act. If there is no conviction, the court dismisses the petition. If there is a conviction, the court holds a hearing right after judgment, but not sooner than five days after service. The law also clarifies that “court” includes a court with criminal jurisdiction for these petitions.
Beginning July 1, 2025, it is unlawful to touch, move, or remove a body, clothing, personal items, or weapons at a violent death or drug-overdose scene. Call the chief of police, the sheriff, or the district attorney at once and wait until they or their staff arrive. You may still give naloxone or another opioid blocker to a person who is overdosing. This protects evidence while allowing life-saving aid.
