New certification rules for recovery homes

Tennessee sets a statewide system to certify recovery homes. Starting January 1, 2026, the department posts an approved list of groups that can certify homes. Selected certifiers must enforce minimum standards, including testing rules, exit plans, good‑neighbor policies, residents’ rights, money‑handling, safety and fire checks, visitor limits, bans on taking residents’ public benefits, and strong ethics rules. When a home’s location is not public, operators must have a way to share it with local officials for safety. Homes already licensed by the department are exempt. The department can make rules now to run this program.

Recovery home addresses kept private

The street address and location of a recovery home are not open to the public under state records law. This protects residents’ privacy and safety. The rule takes effect January 1, 2026.

Renewals, inspections, and transition for recovery homes

Beginning January 1, 2026, recovery home certifications can last no more than three years. To stay in good standing, each site must be inspected in person by the certifier at least once a year. Homes certified before January 1, 2026 get a transition: they can follow prior standards until their next renewal on or after July 1, 2026, or January 1, 2027, whichever comes first.

What counts as recovery homes and treatment facilities

The law defines recovery residences as substance‑free homes with peer support. They cannot provide on‑site medical care or give medicine, except to check abstinence. It also defines which places count as alcohol and drug treatment facilities, and which do not, such as certain university DUI schools, licensed or certified facilities, correction programs, and recovery court programs. These definitions apply starting January 1, 2026.
