Sue when intimate deepfakes are shared

Beginning July 1, 2025, you can sue if someone intentionally shares an intimate digital image of you without consent and knew or recklessly ignored that you did not agree. Consent to make is not consent to share; sharing consent must be a plain‑language written, signed agreement that describes the image and any work it appears in. Courts can order the person to stop showing or sharing the image, and you may ask to use a pseudonym when seeking these orders. If you win, you can choose your damages: your actual losses or $150,000 in set damages, plus the defendant’s profits, possible punitive damages, and your legal costs. A parent, guardian, estate representative, or court‑appointed person (not the defendant) can sue for a minor, incapacitated, or deceased person. You cannot sue for good‑faith reports to law enforcement, disclosures in a legal proceeding, or disclosures reasonably meant to help you, and disclaimers are not a defense.

Criminal penalties for harmful deepfakes

Beginning July 1, 2025, it is a crime to share, threaten to share, or ask others to share an intimate digital image to harass, threaten, alarm, or harm money or reputation, or when you know or recklessly ignore that it will cause harm. Most violations are a Class E felony. The offense is a Class C felony if the conduct could affect a government proceeding, including an election, or help cause violence. A disclaimer that the image was unauthorized or that the person did not participate is not a defense.

Protections for platforms that remove images

Beginning July 1, 2025, online platforms and telecom services are not liable, civilly or criminally, when they act in good faith to remove or limit access to intimate digital images or enable others to do so. They are also not liable for content posted by another person in violation of this law.
