3 provisions identified: 1 benefits, 1 costs, 1 mixed.
The department must fund approved business costs for eligible licensed nonblind operators with disabilities through their individualized employment plans. Covered costs include goods, services, starting stock, and regular business expenses. The department cannot use the blind operators’ program funds, including set-aside and unassigned funds, for this support. The law sets no dollar amount.
Tennessee’s Department of Human Services must create rules for training and licensing eligible residents with disabilities to run public-property vending facilities. Its rehabilitation division must find rehabilitation feasible, approve eligibility for services, and establish an individualized employment plan under federal law. The pathway covers facilities where the department has first priority and blind operators decline to operate, or facilities generating no unassigned income under state law when this law took effect. Licensed blind operators keep first choice; eligible licensed nonblind operators get second choice. When a nonblind operator leaves, the department must check whether blind operators still decline before assigning another nonblind operator.
The department must create complaint processes for public-property managers reporting vending operators’ conduct or performance. It must investigate complaints about licensed blind operators and eligible nonblind operators with disabilities. A confirmed complaint against a blind operator requires a corrective-action plan. The department may also require retraining, place the license on probation, or order emergency removal or removal for cause. The law does not require a specific disciplinary outcome for nonblind operators.
