Beginning July 1, 2026, minors ages 14–17 may make and publish their own videos and must receive 100% of the proceeds from that content. When a qualifying minor appears in a paid video, the creator must deposit a share of the segment’s gross earnings into a trust at a bank, credit union, or trust company. The deposit must be at least half of the minor’s content percentage; if two or more minors qualify, that share is split equally. The account is for the minor’s benefit and becomes available at age 18 or upon emancipation, and it must follow Tennessee’s Uniform Transfers to Minors Act. Creators must keep age, time, pay, and trust‑deposit records for these teens until the minor turns 21 and tell the minor the records exist.
Beginning July 1, 2026, a minor can sue to enforce the trust‑account rules and recover actual damages (including owed pay), punitive damages, and lawsuit costs, including attorney fees. A court may also order a creator to stop breaking the law and take other fair steps. These remedies add to any others available under law. Any contract that tries to waive these protections is void and cannot be enforced by a court or arbitrator.
Beginning July 1, 2026, minors under 14 may not do paid content creation under this law. A creator who features a child under 14, or a parent who allows it, must pay a $2,000 civil penalty for each instance. The creator also owes any compensation due to the minor under the trust rules. Penalties are paid to the Tennessee Commissioner of Labor and Workforce Development to administer the law.
Beginning July 1, 2026, a minor age 14 or older, or an adult who was under 18 when their likeness was used, can demand removal of videos showing them. The person who shared the content, the account holder, or anyone who controls the account must delete the video from the platform.
Beginning July 1, 2026, a minor is engaged in content creation if, in the prior 12 months, at least 30% of a creator’s compensated videos made in a 30‑day period feature the minor. The videos must meet the platform’s pay threshold or pay at least $0.01 per view. Minors who appear only incidentally in videos of public events, like concerts or sports, are not counted.
