Delivery and privacy rules for financial records
Beginning July 1, 2026, Tennessee financial-record custodians must follow the delivery method and location stated in a subpoena. If no method is stated, the custodian and subpoena issuer must use an agreed method, which can include electronic delivery. Without agreement, the custodian can use physical delivery, U.S. mail, or a delivery service; without a stated location, delivery goes directly to the issuer. The issuer must keep received records secure and private. Sharing is limited to people or groups entitled to view the records for the proceeding that prompted the subpoena.
Customer notice rules for financial record subpoenas
Beginning July 1, 2026, Tennessee law requires customers available for service to receive a copy of a financial records subpoena. Service must use methods allowed by law for subpoenas. When the customer is a named party in a court case, service can instead follow Tennessee's rules for later court papers. If a financial institution reasonably believes the customer has died, it need not confirm service on the customer, estate, or heirs.
