Tougher sentences in child rape cases

Beginning July 1, 2026, Tennessee strengthens sentencing for rape of a child and aggravated rape of a child. Judges must weigh more aggravating facts, like a victim under 4, incest, abuse of trust, filming the crime, drugging the victim, using a weapon, or multiple victims. A victim’s participation or consent does not lower the sentence in these child-rape cases. The same sentencing process used for first-degree murder now also applies when someone is guilty of rape of a child. These changes apply to acts occurring on or after July 1, 2026.
