You can still sue child care providers

Beginning July 1, 2026, you can still sue the child care provider. The employer’s safe harbor does not block claims against the provider for its own acts. Your rights to seek damages from the provider stay in place.

Liability shield for employers hosting child care

Beginning July 1, 2026, Tennessee gives employers and host sites a liability shield when a licensed child care provider operates on their property. They are not liable for the provider’s acts or omissions. The shield does not apply if they run, control, or manage the provider, are the licensed provider, or hire or supervise the provider’s staff. It also does not apply if their gross negligence or willful misconduct directly causes the harm. Giving space, utilities, maintenance, security, building upgrades, or money alone does not count as control.
