Beginning July 1, 2026, selling nitrous oxide in a vape shop setting brings steep civil fines. First violation: up to $500 per product. Second within 12 months: $750–$1,000 per product and a 30-day license suspension. Third within 12 months: $1,000–$1,500 per product and license revocation. A manufacturer who knowingly causes these retail sales owes $10,000 per product. The state can also recover investigation costs and attorney fees. Repeated violations count as a deceptive trade practice.
Beginning July 1, 2026, vape shops and vape product distributors in Tennessee cannot sell nitrous oxide at retail. The ban covers retailers, distributors, wholesalers, and importers who sell vapor products in the state. Nitrous oxide means N2O or any product that contains it. A retail sale means a sale to a customer for use or consumption. A vape shop includes premises that sell e-cigarettes, liquid nicotine, or vapor products.
