$35,000 homestead payout if home sold

Beginning July 1, 2026, if real estate cannot be set apart as a homestead, the court orders a sale. $35,000 of the proceeds must be invested in real estate for a homestead, or the court may order a $35,000 cash or personal property payout instead. The payment goes to the surviving spouse; if no spouse, it goes to a minor child or to an adult child age 18 or older with a qualifying disability. This replaces other homestead rights in that real estate.

Homestead stays for spouses and qualifying kids

Beginning July 1, 2026, when the head of a family dies, the homestead exemption continues. It protects the surviving spouse and also a minor child or an adult child age 18 or older with a developmental or intellectual disability. The spouse or qualifying child must live in the home as their main residence to keep this protection. Courts assign and set apart the homestead under the probate rules. The law uses the same disability definitions as in § 52-1-101.
