Right to sue over intimate images

The law creates a civil claim if someone shares your intimate image in violation of Tennessee law. Consent to make an image is not consent to share it. Sharing consent must be a plain‑language writing you sign that describes the image. You can recover the sharer’s profits, your actual damages (including emotional distress), or $150,000. Courts may also award punitive damages and your costs and attorney’s fees. Judges can order takedowns, let you use a pseudonym, and review evidence in private. A “no permission” disclaimer is not a defense. Good‑faith sharing with law enforcement, in a court case, or to help you is exempt. “Distribute” means transfer, publish, disclose, or make accessible. An “intimate image” is a photo, video, or broadcast of private parts or sexual acts of an identifiable person. Beginning July 1, 2026, this right applies to harms that happen on or after that date.

Platforms shielded for blocking images

Online services are not liable under this law for good‑faith steps to block or limit intimate images. They are also not liable for tools that help others restrict access, or for content posted by someone else. These protections begin July 1, 2026. This reduces legal risk for platforms, but it may narrow who victims can sue.
