Easier path for eligible expungements

The law creates a rebuttable presumption to grant expungement if you qualify under § 40-32-107(a)(1)(A)-(E) and meet the other rules. A presumption means the judge starts from yes, unless evidence shows otherwise. This makes it easier for eligible people to clear their records. The law takes effect immediately.

New rules for pardoned expungements

The law changes expungement after a pardon. It removes the old “nonviolent crime” wording. It blocks expungement for first- or second-degree murder; especially aggravated kidnapping or robbery; aggravated child abuse; terrorism; and any sex offense that requires registration or involves a minor. Attempts, conspiracies, facilitation, or solicitations of those crimes are also blocked. For pardoned cases, judges must weigh your interests against justice and public safety and consider whether the offense was violent. The law takes effect immediately.
