The law sets a firm filing deadline for the line-of-duty death annuity. File with the Department of Finance and Administration within three years of the later of the death or the final line-of-duty ruling. Late claims are barred. If a claim is denied, the estate has one year to ask for review. Law enforcement cases go to the Peace Officer Standards and Training Commission. Firefighter or volunteer rescue cases go to the Commission on Firefighting Personnel Standards and Education; the Commissioner does not take part but can testify if asked. EMT cases go to the Tennessee Emergency Medical Services Board. Each board can issue a binding final order and must send copies to the estate and the Department of Finance and Administration.
The law takes effect now and applies back to March 1, 2020, unless prohibited by the U.S. or Tennessee Constitutions. The retroactivity covers the three-year filing rule and the one-year appeal rights. This lets estates have these rules apply to deaths or rulings on or after March 1, 2020.
