Attorney general now replaces commission

The law names the attorney general, not the former commission, as the office for these duties. It also repeals all rules that were moved from the commission to the attorney general. This aligns the code with the current structure for civil rights enforcement.

Conciliation agreements can be public

The law removes the prior rule that kept conciliation agreements private unless both parties agreed and the attorney general allowed release. Now these agreements may be disclosed without both parties’ consent. This improves transparency but reduces privacy for people who settle a case.

New rules for discrimination case records

The law keeps complaints and investigation files confidential. They cannot be shared outside the attorney general’s team without the producer’s consent, unless a court orders it for good cause. The attorney general may share documents with the complainant, the respondent, their lawyers, and with state or federal agencies enforcing antidiscrimination laws. The attorney general may use copies of these materials for enforcement and in court. Materials given voluntarily are treated like formally demanded records if they came from another attorney general or from a person with relevant information.
