If a bond condition limits your contact, custody, or visitation with a child, the court must hold a hearing within 15 calendar days. If the hearing is not held in 15 days, that bond condition is void. Before a judge can impose or extend a pre-conviction bond limit for a minor child who is not a victim, the government must prove a real threat of harm, show less restrictive options will not work, and show the limit is in the child’s best interest. The court must make specific findings of fact. The law presumes parent-child contact is in the child’s best interest.
