Beginning July 1, 2026, prohibited foreign parties and foreign‑party‑controlled businesses cannot buy or hold any interest in non‑agricultural land in Tennessee. They also cannot hold land through an agent, trustee, or other fiduciary. Any barred holding stays a violation as long as the party keeps the interest. If a violation is found, the owner must divest within two years. If not, the Attorney General may sue to force a sale or other remedies. A violation is a Class A misdemeanor, punishable by a $1,500 fine, up to 11 months and 29 days in jail, or both.
Beginning July 1, 2026, any prohibited foreign party or foreign‑party‑controlled business that holds non‑agricultural land on or after January 1, 2025 must register with the Tennessee Secretary of State. File within 60 days after January 1, 2025, or within 60 days after acquiring the interest, whichever is later. The filing must list the owner’s legal name, street and mailing addresses, birthplace, and nationality; any agent, trustee, or fiduciary; the business purpose and how the land serves it; parent, subsidiary, and intermediary names and addresses; and other U.S. non‑agricultural land interests if they total more than 250 acres. The Secretary must report suspected violations to the Attorney General. If registration is late, the Secretary may assess a civil penalty up to $2,000 per violation.
