Caps on fees for wage advances

The law caps what licensed earned wage access providers can charge. For any advance of $75 or less, the fee cannot be more than $5. For any advance over $75, the fee cannot be more than $7.50. Starting January 1, 2030, and every five years after, the Division updates these caps for inflation using the U.S. city average CPI and posts the changes on the DFI website.

New legal rules for wage advances

If a licensed provider follows this chapter, certain state consumer and finance laws do not apply to its earned wage access services. The exemption only covers providers that are licensed and in compliance. The new chapter’s rules, not those other statutes, govern these services.
