Parents need court OK to move 100 driving miles

The law defines “driving miles” as road distance and uses it for the 100‑mile rule. You may not move with the child 100 driving miles or more from the other parent without that parent's consent or a court order (except cases under s. 767.001(1)(g) or (h)). If both parents have court‑ordered placement, you must file a motion and get a court order before such a move. You also may not take the child out of Wisconsin for more than 90 straight days or conceal the child without consent or a court order. Parents can file a written agreement to allow the move and set custody and travel‑cost terms; the court adopts it unless not in the child's best interest.

Simpler notice when 100+ driving miles apart

If you and the other parent already live more than 100 driving miles apart, you do not need to file a motion to move. You must give the other parent written notice at least 60 days before moving. The notice must list the move date and your new address.
