Special tax district rules for two data centers

The law creates special tax district rules for data centers. A district qualifies only if the site is a state-certified data center and every project cost is for that data center. The usual 12% city limit check does not apply when the city creates or changes that district. When the city creates or changes another district, it must leave this data center district’s value out of the 12% math. The data center district cannot add non–data center costs to its plan. It also cannot allocate positive tax increments to other districts or uses. This applies only to Port Washington TID No. 5 and Beaver Dam TID No. 10.
