New teams to review deaths and prevent them

The law creates fatality review teams to study certain deaths and prevent future deaths. Local teams can be formed by two or more cities, counties, or tribal or local health departments. Teams may review suicides; homicides and deaths tied to domestic, partner, or community violence; motor vehicle crashes; overdoses; child abuse or neglect; stillbirths; fetal or infant deaths; maternal deaths during or within a year of pregnancy; and any unexpected or unintentional child death. It excludes deaths already reviewed under another state process. Teams must set a clear purpose, follow a protocol, collect and secure data, make prevention recommendations, track actions, and check results across agencies. Counties can recognize these teams for child death reviews, including in very large counties where the state or its contractor handles child welfare.

Stronger privacy for child and family records

Law enforcement records about children and pregnant people are kept separate and are not public. Juvenile court and social services records about children and families are also confidential. These records can be shared only in the limited cases listed in law or by a judge, including when a fatality review team is allowed to review them. This protects family privacy while allowing targeted safety reviews.

Health records sharing for review teams

Health care providers and treatment providers can share patient and treatment records with a fatality review team when it reviews a death. For this purpose, the team acts as a public health authority. Sharing is allowed even when these records are usually private. Teams and members must keep the records confidential and use them only as allowed by law.
