Owners can remove unlawful property filings
If someone files an unlawful instrument on your property, you can sue to remove it. If you win, the court releases your property and may award actual damages, costs, and reasonable attorney fees. You can record the court order with the county. A violator can be fined up to $10,000 or jailed up to 9 months, or both. Registers of deeds and government employees acting in official duties are not punished.
Stops liens that don't improve property
The law bans recording contracts that do not improve real estate but claim a lien on it. County registers of deeds can refuse and return these papers unrecorded. The right to record is now subject to these limits, and registers must follow the new rules. Normal items can still be recorded, like mortgages and loan security, HOA or condo documents, commercial lease papers, deed covenants with ongoing duties, and liens allowed by law. These rules apply to instruments filed on the law’s effective date.
