Stronger protection for homeowners against improper liens
Wisconsin law bars filing, recording, or presenting contracts that claim a lien or other security right on real estate when the promised work, labor, services, materials, plans, or specifications do not improve it. The ban also covers related notices and documents, and registers of deeds may reject and return covered documents unrecorded. Exceptions cover loan-security documents, documents allowed by specified laws, homeowners’ association and common-interest community documents, and commercial lease documents. Exceptions also cover liens from ongoing obligations, such as maintenance payments, access easements, commercial operations, or property management, and liens under section 779.32. Affected property owners can sue the person who filed or recorded the document; if owners win, the court must release the property from its effect. Courts may also award actual damages, court costs, and reasonable lawyer fees, in addition to other available remedies. Violators face a fine of up to $10,000, up to nine months in jail, or both. These remedies do not apply to registers of deeds or government employees acting in their official duties.
