Subpoenas for officers and public employees at work

The law requires subpoenas for law enforcement officers, tribal officers, public officers, and public employees to be served at the person’s work street address when the testimony is about job duties. Service can be by showing and reading the subpoena, handing a copy to the person, or leaving a copy at the work address. In criminal cases, this same work-address rule applies and overrides rules that allow service at a home address. The law also defines address: usually it means a person’s home street address; for these public witnesses it means the employer’s address; for people in the address confidentiality program, it means the DOJ-assigned address.
