Providers can refuse virtual credit cards

The law bars health insurers from forcing health care providers to take virtual credit card payments. Beginning on the law’s effective date, before an insurer sends a first virtual-card payment, it must disclose any fees for each payment option and explain other ways to get paid, with clear steps to choose a non–virtual card method. If a payment is sent under federal EFT standards (45 CFR 162.1602), the insurer or its vendor cannot charge a transmission fee unless the provider agrees. These notice and option rules cannot be waived, and any contract term that tries to waive them is void. The no‑waiver rule applies to contracts entered into, renewed, or changed on the law’s effective date.
