Felony to disarm peace or correctional officers

The law makes it a Class H felony to intentionally take a weapon or certain devices from a peace officer on duty, without consent. It covers items the officer carries or that are in the officer’s immediate area. It also makes it a Class H felony to take a weapon, those devices, or official items from a correctional officer on duty, without consent. Official items include a radio, keys, or other gear. The law defines correctional officers as state or local guards who supervise and discipline inmates, and it includes juvenile correctional officers. This expands protection beyond peace officers to include correctional officers.
