Police can use oral fluid DUI tests
The law lets police ask for a breath or oral fluid sample before arrest when they have probable cause of drunk or drugged driving. This also applies when alcohol or drugs are detected on a commercial driver. Officers must use a state‑approved device. Police can use the quick test result to decide whether to arrest and whether to request full chemical tests under state law.
Roadside test limits and no refusal penalty
In court, a roadside breath or oral fluid test result is not used to prove guilt. It can be used only to show probable cause for an arrest if that is challenged, or to show that a full chemical test was properly requested. Refusing the quick roadside test does not trigger the general penalty in state law. Police can still require full chemical tests under separate rules.
