Harsher penalties for carfentanil crimes

The law sets weight-based felony penalties for making, selling, or delivering carfentanil. Ten grams or less is a Class E felony. More than 10 grams up to 50 grams is a Class D felony. More than 50 grams is a Class C felony. The same weight rules apply to possession with intent to make, sell, or deliver. When one of the law’s listed aggravating circumstances is present, the court can add 5 years to the maximum prison term. When counting the amount, courts include the drug plus any mixture or diluent.

Combined drug charges and later prosecutions

In controlled-substance cases, including carfentanil offenses, prosecutors can combine several violations into one charge if done under one plan. A verdict on that combined charge does not block later charges for other acts if no evidence about those acts was used at the first trial. This streamlines cases for prosecutors and can increase exposure for defendants.
