People born with a medically recognized difference in sex development keep legal protections and accommodations under applicable law. State programs cannot deny those rights because of the condition.
Any school district, public school, state agency, or political subdivision that collects sex data must use sex at birth. This applies when sex is recorded to follow anti‑discrimination laws or to gather public health, crime, economic, or other data. It can reduce privacy or recognition for people whose current sex differs from their birth sex.
The law defines sex as a person's biological sex at birth. It says woman and girl mean females, and man and boy mean males. It states that equal does not mean the same, and separate male and female spaces are not inherently unequal. Schools, sports, prisons, shelters, locker rooms, restrooms, and similar places may enforce separate accommodations for males and females to protect safety and privacy. This can limit access or recognition for transgender and gender‑diverse people.
