A district judge can send any case in that court’s power to a circuit or chancery judge. For civil cases over $50,000, every plaintiff and every defendant must agree before a transfer. A circuit judge can also assign cases to a district or chancery judge, under the limits in the statute. Chancery judges can hear any case assigned to them under these rules.
The law takes effect right away once it completes the steps to become law under Article 4, Section 8 of the Wyoming Constitution. The new assignment and expense rules apply immediately after that point.
The law lets retired Wyoming justices and judges (who retired under W.S. 5-1-106) serve again, if they are not practicing law and agree. A district or circuit judge can request it with the chief justice’s OK, or the chief justice can assign them. While assigned, the retiree is paid the same salary as a judge of that court and gets the same per diem and travel, paid by the court where they serve. This pay does not reduce the retiree’s pension, and assignments cannot risk the state retirement plan’s status. When a chancery judge is assigned to hold court in district or circuit court, the hosting court pays the judge’s travel and other expenses from its fund.
