Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 2 costs, 1 mixed.

Colleges must separate housing and bathrooms by sex

Beginning July 1, 2025, colleges must label and use multi‑user bathrooms, changing areas, and sleeping rooms by sex. Student housing must offer an option to live only with people of the same sex. Schools must provide private changing areas that are separated by sex. Single‑occupancy unisex rooms, staff duties when no one is undressed, medical help, emergencies, and some sports settings are exceptions. If you meet an opposite‑sex person in a sex‑designated area, or are required to share sleeping quarters with the opposite sex, you can sue within four years. You can seek a court order to stop violations, get $5,000 for each instance, other money damages, and attorney fees.

Sue government over opposite-sex facility access

Beginning July 1, 2025, you can sue a government facility if it lets an opposite‑sex person into a sex‑designated restroom or changing area, or fails to take reasonable steps to prevent it. You can also sue if a correctional facility requires sharing sleeping quarters with the opposite sex. If you win, you can get actual money damages and reasonable attorney fees and costs. The law also makes sure these claims are not blocked by general governmental immunity.

Public restrooms and locker rooms by sex

Beginning July 1, 2025, public buildings must label multi‑user restrooms, changing areas, and sleeping rooms for males or for females only. Only people of that sex may use those multi‑user spaces. Single‑occupancy unisex rooms are allowed. Workers can enter to clean when empty, and medical help or official duties are allowed. Temporary emergency uses and some fully clothed sports‑team situations are allowed. Reasonable accommodations cannot allow entry to opposite‑sex multi‑user spaces where opposite‑sex people are or could be present.

Key terms for sex-separated facilities

Beginning July 1, 2025, the law defines key terms like restroom, changing area, sleeping quarters, public facility, educational facility, correctional facility, governmental entity, and sex (male and female). These definitions control who the rules cover and where they apply, including government buildings, colleges, and prisons.
