County clerks must report each recorded property deal that is in or within five miles of a critical infrastructure zone. They must send the report to the Homeland Security director and the Division of Criminal Investigation within 15 days. The law also removes an old subsection that required a separate list for clerks. These rules take effect July 1, 2025.
The law explains what a covered “conveyance” is. It includes deeds, mortgages, leases, and assignments for land, buildings, and rights like minerals and pore space. Wills are not covered. It uses the U.S. Commerce Secretary’s “foreign adversary” list (15 C.F.R. 791.4(a)) to define designated countries or persons. These definitions guide reporting and investigations starting July 1, 2025.
The Division of Criminal Investigation and the Homeland Security director review reported deals to confirm they are in or within five miles of a critical zone. If they have reasonable suspicion, they investigate for foreign adversary ties, hidden identities, or threats to state or national security. The attorney general, or the division with the attorney general’s approval, can subpoena records and witnesses. The Homeland Security office can receive and share criminal identification, intelligence, and history data for these purposes. These authorities start July 1, 2025.
