Extra courtroom help for child victims

Beginning July 1, 2025, in cases of incest, sexual assault, human trafficking, or violent felonies with a victim under 18, courts may give extra help to the child. Judges may use age‑appropriate questions and oath, stop nuisance or harassing tactics, allow a supportive person to sit close and visible if that person will not be a witness, and give breaks. Judges may also allow a certified therapy dog or a comfort item in the room.

Remote child testimony and room exclusions

Beginning July 1, 2025, courts may let a child under 18 in incest or sexual‑assault cases testify outside the defendant’s and jury’s presence. The judge must first hold a hearing and find that in‑court testimony would cause more than minimal emotional distress and that remote testimony is needed. The court may keep the defendant out of the room if their presence would likely cause serious distress that hurts the child’s ability to speak. If excluded, the child testifies live by secure two‑way video; the courtroom sees the child, and the child sees the courtroom and defendant on a monitor. The defendant can waive showing their image in the child’s room. The court must give the defendant real‑time contact with their lawyer and allow reasonable breaks. On the prosecutor’s motion, and with specific findings, the court may also keep the jury out and show the child’s live testimony in the courtroom.

New rules on child witness videos

Beginning July 1, 2025, a court may use the new remote‑testimony process instead of a videotaped deposition for a child witness. But if the prosecutor takes an admissible videotaped deposition and the child will not or cannot testify live under the new process, the child cannot later testify live without the defendant’s consent.
