Beginning January 1, 2026, county boards must hold a public hearing 45 to 90 days after they find an application complete. Applicants can agree to a later hearing date. The county must take written public comments for at least 45 days after the application is deemed complete. Within 60 days after the hearing ends, the board must issue findings and grant or deny the permit. These rules apply to new wind and solar permit applications filed on or after January 1, 2026.
Beginning January 1, 2026, when the Department of Environmental Quality asks for more information on an incomplete application, applicants have 45 days to respond. The director must act on a permit application within 120 days after receiving it. These timelines apply to applications filed on or after January 1, 2026.
