Inherited cars keep existing loans

Beginning July 1, 2025, if you inherit a vehicle by a beneficiary form, it still carries any loans, liens, or security interests. Creditors’ claims on the vehicle continue after the transfer. This can reduce the value you receive and limit what you can do with the vehicle.

Less risk for estates and heirs

Beginning July 1, 2025, a personal representative is not liable for getting a new title under a beneficiary form if they do not have actual knowledge of a valid, unrevoked designation. A successor, or someone acting for a successor, is also not liable without actual knowledge. This protects estates and heirs from transfer-related liability when they are unaware of a valid form.

Name a car beneficiary to skip probate

Beginning July 1, 2025, you can record a simple form with your county clerk to name one or more beneficiaries for your titled vehicle. The form must list the make, model, year, VIN, all owners, say "transfer on death to" with the beneficiary name, and be notarized. After the owner dies, the beneficiary brings the recorded form (or a copy), a certified death certificate, and pays the standard title fee to get a new title. The transfer is nonprobate and follows special steps instead of the usual title assignment rules. The new title is still subject to any existing liens or loans on the vehicle.

State issues standard forms and rules

The Wyoming Department of Transportation must create and supply standard title and beneficiary forms to county clerks at cost. The department must adopt rules and allow appeals through the Office of Administrative Hearings. These rulemaking duties take effect immediately under the law.

Owner stays in control until death

Beginning July 1, 2025, the beneficiary has no rights while the owner is alive. The owner does not need the beneficiary’s consent to sell, trade, or retitle the vehicle. The owner can cancel or change the beneficiary by properly transferring the title or by signing and recording a new beneficiary form. Ownership vests in the beneficiary only when the owner dies.
