Irrigators must use water before next transfer

Beginning July 1, 2025, after a temporary transfer of an irrigation right ends, the right must return to irrigation use before another transfer. The required use period is at least half the time the last temporary transfer ran, including extensions. Example: a 4-year transfer means at least 2 years of irrigation use before the next transfer.

No temporary transfers that harm others

Beginning July 1, 2025, the state engineer cannot approve a temporary water transfer that injures another appropriator’s rights. Temporary use is allowed only when other water users are not harmed.

Longer temporary water use for projects

Beginning July 1, 2025, temporary water use for short-term projects can last up to 5 years. The state engineer may renew it for more periods, each up to 5 years. The total time for the same purpose and place cannot be more than 10 years. These transfers are allowed only when no other water right holder is injured.

Only DOT can buy highway water

Beginning July 1, 2025, for highway construction or repair under a state DOT contract, only the state transportation commission may acquire the water. The commission must manage the purchase and pay all fees and royalties. It cannot delegate this to a contractor or any third party.
