Beginning July 1, 2025, you can call for medical help during a drug overdose without being charged for possession or for using/being under the influence tied to that event. The protection covers possession and use/under‑the‑influence crimes and only if the charge comes from the same overdose event. To qualify, you must reasonably believe an overdose is happening, give the exact location, stay at the scene or medical facility until responders arrive, and cooperate, including sharing info about the person and the suspected drug. The protection covers the caller and the person overdosing. The person overdosing can get this protection no more than twice in 12 months; the second time requires finishing a district attorney‑approved treatment program after a substance use assessment you pay for. The caller is not subject to the two‑time limit. It does not apply if help is sought because of drug use during a lawful police search or arrest. It does not cover other crimes, and police can use your statements to investigate other offenses.
Beginning July 1, 2025, Wyoming includes the new overdose‑immunity section within the Controlled Substances Act. This makes cross‑references clear and helps people and courts find and use the immunity rule.
