If you hold a reservoir storage right or own a lawful dam or diversion, you can ask the Board of Control for more time to use the water. Each approved extension can last up to five years. You must show you used due diligence and had a reasonable cause for nonuse, like repairs or replacement, court or agency delays, long planning or financing, or rules beyond your control. The Board uses the state administrative hearing process to review requests. An approved extension blocks abandonment actions during the extension, and you may apply for more five‑year extensions.
If you do not use any of your appropriated surface, underground, or reservoir water for five straight years, the State Engineer may start forfeiture proceedings before the Board of Control. The Engineer must name the affected area, which cannot include more than one water division, and hearings go to the division superintendent. Time when there was no water available to divert during an irrigation season does not count toward the five years. This process does not apply to reservoirs, dams, or diversions that have an active Board extension.
