Summary

Countering Chinese Communist Party economic espionage and theft of U.S. intellectual property. This bill would create a dedicated CCP Initiative inside the Department of Justice to investigate and prosecute trade secret theft, hacking, and use of researchers to transfer sensitive technology, and to coordinate reviews of risky foreign investments under FIRRMA with the Department of the Treasury.

New DOJ effort to stop Chinese spying

If enacted, this bill would create a CCP Initiative inside the DOJ National Security Division to counter Chinese spying and economic espionage. It would prioritize prosecuting trade secret theft, hacking, and economic espionage and protect critical infrastructure and small businesses. The DOJ would investigate investments by companies on the Commerce Entity List and the Defense PRC Military Companies list and report findings to the Secretaries of Commerce and Defense. The Attorney General would coordinate with the FBI and other agencies, and the Initiative would use resources set aside only for it. The bill would require yearly reports to specific congressional committees, take effect on enactment, and end six years later. If a court voids one part, the rest would continue while the law is in effect.
