STATES Act

Sponsored By: Representative McCormick, Richard [R-GA-7]

Introduced

Summary

Federal cost recovery from States for National Guard deployments would let the President require states to repay the federal government for costs when their National Guard units are federally activated if the state is later found negligent. The bill also names the three triggers for federal activation, allows waivers, and applies retroactively to June 1, 2025.

  • States and governors would face direct financial risk. If the President determines negligence within 30 days after a deployment ends, federal funds to the state may be cut equal to 100% of the federal costs after the governor is notified.
  • National Guard units and members could be federalized under three specific triggers: invasion or threat of invasion, rebellion or threat of rebellion, or when regular forces cannot enforce federal law. Orders would go through state governors or the District of Columbia commanding general.
  • The federal government would get a formal recovery process. The Secretary of Defense would coordinate with the Treasury to calculate costs and the President may waive repayment for extreme state financial hardship or when the deployment protects federal property or enforces federal law.

States repay costs for Guard call-ups

This bill would let the President call State National Guard units into federal service during an invasion, a rebellion, or when regular forces cannot enforce federal law. Orders would go through state governors, or the D.C. Guard commander. If, within 30 days after the action ends, the President tells the Governor that state negligence caused the call-up, the federal government would cut that state's funds by 100% of the federal costs. The President could waive the payback for extreme state financial hardship, or if the mission mainly protected federal property or enforced federal law. The policy would apply retroactively to deployments on or after June 1, 2025.
