Summary
Limited, alliance-based exceptions for Coast Guard shipbuilding. This bill would let the President authorize building Coast Guard vessels in certain foreign shipyards when doing so is in the national security interest and costs less than building in a U.S. yard.
Show full summary
- It lets the President approve exceptions to the rule barring foreign construction if two conditions are met: national security justification and lower cost than domestic construction.
- Only shipyards in NATO countries or in Indo-Pacific countries that are party to a mutual defense treaty would qualify, and the Coast Guard Commandant must certify the shipyard is not owned or operated by a Chinese company or by a multinational domiciled in the People’s Republic of China.
- The President must notify Congress of any exception and contracts cannot be made until after a 30-day waiting period. The bill also adds a cross-reference to this new subsection in 10 U.S.C. 8679(a).

Narrow exceptions to build Coast Guard ships abroad
If enacted, the President could let some Coast Guard ships be built in foreign shipyards when it helps national security. The yard would have to be in a NATO country or an Indo-Pacific treaty ally, and the build would have to cost less than in the United States. Before construction starts, the Coast Guard Commandant would have to certify the yard is not owned or run by a Chinese company or a multinational based in the People’s Republic of China. The President would have to tell Congress, and no contract could be signed until 30 days after Congress gets the notice. These changes would take effect upon enactment.
