Summary

Medicare Advance Directive Certification Program creates a national, CMS-run framework for electronically storing, accrediting, and sharing certified advance directives so beneficiaries and caregivers can find and use patients’ documented wishes when someone is incapacitated.

Show full summary
  • Beneficiaries and families gain near real-time online access to a certified advance directive on CMS platforms and can request hard copies. Enrollment is voluntary, and participants keep ownership and may enroll, update, or terminate a directive at any time.
  • Providers and suppliers can view and share a participant’s certified directive to guide treatment. CMS will host statutory and alternative state forms and must display attorney opinions explaining state-law compliance for alternative forms.
  • Vendors, accreditation groups, and states must meet HIPAA privacy, security, and interoperability standards, submit to annual quality reviews, and follow a 60-day process for posting alternative forms. The Secretary must fully implement the Program within 5 years and may remove noncompliant forms from CMS sites.

If enacted, the bill would create a voluntary Medicare Advance Directive Certification Program for people with Part A or Part B. The Secretary would accredit vendors that offer electronically stored advance directives and require participants to say where their directive is kept or how to access it. CMS would post statutory and state alternative forms, provide near real-time online access for participants and authorized providers, and give hard copies on request. Enrollment would be voluntary, beneficiaries could cancel at any time, systems must follow HIPAA, and the Secretary would have five years to fully implement the Program.
