Bill Overview

Analyzed Economic Effects

5 provisions identified: 2 benefits, 1 costs, 2 mixed.

Utah funds energy projects and training

Effective May 7, 2025, the Utah Energy Council coordinates baseload power projects, sets development plans, and reviews research and funding proposals. It manages a new investment fund financed by property tax revenue from designated energy zones. The fund can support infrastructure, federal grant matches, workforce training, project incentives, and related administrative costs. The council must report annually by October 31. The law provides no immediate appropriation or direct household payment.

Local energy revenue must support housing

Energy-zone tax revenue not allocated to the Utah Energy Council goes to the applicable county or city. Cities must spend at least 10% of their share on affordable housing programs. Counties must place at least 10% with a registered housing nonprofit serving an association representing 10 or more Utah counties. Remaining local money supports efforts to address energy development's local impacts. The law states no total housing allocation or household payment.

Utah nuclear advisory group ends in 2027

The law ends the statutory Nuclear Energy Consortium on July 1, 2027. The group advises Utah officials on nuclear energy policy, incentives, partnerships, and regulation. The repeal names no replacement and specifies no direct household cost or benefit.

New energy zones limit local incentives

Counties, cities, and state land use authorities can apply for energy zones using boundary, infrastructure, and development information. The council must decide within 60 days and approve applications showing suitable land and meeting statutory development-plan criteria. Overlap with community reinvestment areas designated as of May 7, 2025, or inland port projects requires a tax-revenue-sharing agreement. Cities and counties cannot offer financial incentives for baseload power projects outside designated zones. Exceptions cover municipal power projects, projects using only intermittent resources, and projects with area plans approved before July 1, 2026.

Zone property taxes support energy investments

Energy zones use the property value on the last equalized assessment roll before zone creation as their tax base. Incremental value equals current taxable value minus that base, multiplied by the share allocated to the reinvestment agency and energy fund. The tax revenue difference compares revenue based on current assessed value with revenue based on the zone's base value. County auditors calculate and report it yearly; treasurers transfer the required share to the energy fund with regular annual distributions. Local allocations and overlap agreements affect the split; no individual household tax-bill change is specified.
